{"id":4615,"date":"2019-06-19T22:47:28","date_gmt":"2019-06-19T22:47:28","guid":{"rendered":"https:\/\/medisysdata.com\/?p=4615"},"modified":"2023-10-15T09:25:19","modified_gmt":"2023-10-15T03:55:19","slug":"prescription-drug-price-transparency-act","status":"publish","type":"post","link":"https:\/\/www.medisysdata.com\/blog\/prescription-drug-price-transparency-act\/","title":{"rendered":"Prescription drug price transparency act"},"content":{"rendered":"\r\n<p>The first piece of prescription-drug pricing legislation emerged from a unanimous vote on the House Ways &amp; Means Committee in April.\u00a0That means the Prescription Drug Sunshine, Transparency, Accountability and Reporting (STAR) Act is well on its way to passage in Congress, either on its own or in any larger health care bill the House and Senate are likely to pass. All the Democrats and Republicans voted for the bill\u2019s passage, a number of them described it, with some defensiveness, as a \u201cfirst step\u201d toward reducing drug prices.<\/p>\r\n\r\n\r\n\r\n<p><strong>H.R. 1035, the\u00a0Prescription Drug Price Transparency Act,<\/strong>\u00a0requires greater transparency and accountability from Pharmacy Benefit Managers (PBMs).<\/p>\r\n\r\n\r\n\r\n<p><strong>H.R. 1034, the Phair Pricing Act<\/strong>,\u00a0lowers the cost of prescription medication for patients in the Medicare Part D program.<\/p>\r\n\r\n\r\n\r\n<p><strong>&#8220;For too long, we have turned a blind eye as pharmacy middlemen have manipulated drug prices to maximize their profit margin. The\u00a0<\/strong><em><strong><a href=\"https:\/\/en.wikipedia.org\/wiki\/Prescription_drug_prices_in_the_United_States\" target=\"_blank\" rel=\"noopener\">Prescription Drug Price Transparency Act<\/a>\u00a0<\/strong><\/em><strong>will protect patients and pharmacies by increasing transparency over the drug pricing process, providing greater oversight to protect taxpayer dollars, and ensuring patients are able to choose their pharmacy,&#8221;\u00a0<\/strong>said Rep. Collins.<\/p>\r\n\r\n\r\n\r\n<p><strong>H.R. 1035\u00a0increases drug pricing transparency and accountability by accomplishing the following:<\/strong><\/p>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\">\r\n<li>Ensures MAC pricing lists are updated every seven days for Medicare Part D, Medicare Advantage Part-D, and FEHBP.<\/li>\r\n<li>Preserves pharmacy access for patients by protecting their ability to choose a pharmacy.<\/li>\r\n<li>Requires PBMs disclose sources used in MAC price determinations.<\/li>\r\n<li>Provides greater oversight to prevent waste, fraud, and abuse of taxpayer funds in Medicare Part D, Medicare Advantage Part-D, and FEHBP\u00a0<\/li>\r\n<\/ul>\r\n\r\n\r\n\r\n<p><strong>H.R. 1034\u00a0protects patients and provides greater oversight by accomplishing the following:\u00a0<\/strong><\/p>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\">\r\n<li>Requires all price concessions between a pharmacy and PBM be included at the point of sale to decrease patient\u2019s costs.<\/li>\r\n<li>Realigns market incentives to ensure patients have access to and receive the best possible care.<\/li>\r\n<li>Directs the Secretary of Health and Human Services to establish a working group of stakeholders to create quality measures based on a pharmacy\u2019s practice.\u00a0<\/li>\r\n<li>Ensures PBMs disclose all fees, price concessions, and programs to CMS.<\/li>\r\n<\/ul>\r\n\r\n\r\n\r\n<h3 class=\"wp-block-heading\">Prescription drug pricing policy<\/h3>\r\n\r\n\r\n\r\n<p>Public sentiment about prescription drug prices has never been clearer \u2013 drug prices are too high.\u00a0 Lawmakers, payers and patients all are concerned about the impact drug price increases have on the health of our country.\u00a0We are, too.<\/p>\r\n\r\n\r\n\r\n<p>One key provision requires manufacturers who increase a drug price either by 10% or $10,000 over one year or by 25% or $25,000 over three years to explain the reasons for the increase.<\/p>\r\n\r\n\r\n\r\n<p>\u201cUnder President Trump\u2019s leadership, CMS is delivering on price transparency, because patients have a right to know the cost of their healthcare services before they receive them,\u201d said CMS Administrator Seema Verma.<\/p>\r\n\r\n\r\n\r\n<p>According to CMS, \u201cThe improvements we are making to Medicare Advantage and Medicare Part D deliver on the promises in the President\u2019s blueprint to provide more negotiating tools and more transparency for patients,\u201d said HHS Secretary Alex Azar. \u201cThey are significant steps toward a Medicare program, a drug pricing marketplace, and a healthcare system where the patient is at the center and in control.\u201d<\/p>\r\n\r\n\r\n\r\n<p>CMS is also codifying a policy that enables beneficiaries to select a Medicare Advantage plan that negotiates prices for physician-administered medicines when beneficiaries are first starting on the medicines.<\/p>\r\n\r\n\r\n\r\n<p>For a fact
